Who is entitled to receive Disability Benefits?

Social Security Disability (SSD)
Under the Social Security Act, a disability is defined as the inability to engage in any substantial gainful activity (SGA) by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.

Supplemental Security Income (SSI) pays benefits to disabled adults or children based on financial need and the amount is determined on what assets and income the claimant possesses.

The majority of Disability claims applications are initially processed in approximately 4-6 months through your local Social Security field offices.

Don't Worry if you are denied!
Approximately 70-80% of all applications are denied. SSA gives you 60 days to APPEAL the denial, which. We will appeal automatically in order to move your case along and to the next step of the disability process.

Reconsideration
At the appeal of the initial determination, the appeal is usually handled by much the same as the initial claim with the exception that a different adjudicative team makes a decision on the appeal.

Appeal to Administrative Law Judge (ALJ)
If you are dissatisfied with the reconsideration determination, then we will request a hearing before an administrative law judge (ALJ), who will issue a decision based on all of the evidence of record, including evidence obtained at the hearing.

Attorneys Fee's
There are no attorney's fees unless I am successful in getting benefits for you. The attorney fee is established by Social Security Administration through its fee agreement process, has established a standard fee which is the lesser of either 25% of all retroactive benefits of the claimant and the entire fee is capped at $6,000.00.
